SOUTH CAROLINA LIBERTARIAN PARTY ISSUES RESOLUTION FOR DEFEND THE GUARD

Columbia, SC – April 8, 2024 – The South Carolina Libertarian Party (SCLP) in its monthly state committee meeting drafted the following resolution calling upon the General Assembly to support Defend the Guard Legislation:

Resolution of the South Carolina Libertarian Party

WHEREAS, Article 1, Section 8 of the Constitution of the United States vests in the United States Congress the exclusive power of war but the Executive Branch has assumed this power without authority; and,

WHEREAS, The Tenth (10th) Amendment of the United States Constitution states: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people”; and

WHEREAS, when such unconstitutional actions are taken by the Federal Government, the proper role of the States is to remedy such situations, as outlined in the Kentucky and Virginia Resolutions of 1798; and

WHEREAS, Article 20 of the South Carolina Constitution states; A well regulated militia being necessary to the security of a free State, the right of the people to keep and bear arms shall not be infringed. As, in times of peace, armies are dangerous to liberty, they shall not be maintained without the consent of the General Assembly. The military power of the State shall always be held in subordination to the civil authority and be governed by it. No soldier shall in time of peace be quartered in any house without the consent of the owner nor in time of war but in the manner prescribed by law.

NOW THEREFORE BE IT RESOLVED, that the South Carolina Libertarian Party requests that HB3308, Defend the Guard, be expedited through the Medical, Military, and Public & Municipal Affairs committees and be allowed a vote on the House floor as soon as possible.

NOW BE IT FURTHER RESOLVED, that we bring home all South Carolina Guard combat troops already deployed to foreign conflicts immediately, that the Governor and the South Carolina Legislature shall not mobilize South Carolina National Guard personnel to foreign service without a formal Declaration of War from the United States Congress.

BE IT FURTHER RESOLVED, that upon approval of this resolution by the South Carolina Libertarian Party Executive Committee, it shall be distributed to all members of the 2025 South Carolina Legislature, the South Carolina Governor, and the Adjutant General of the South Carolina National Guard, and with copies to print, broadcast and social media in the State of South Carolina.
